ilumivu (“us” or “we”) understands how important the privacy of personal information is to our users. This Privacy Policy will tell you what information we collect about you, others and your use of our website (the “Site”), the content of the Site (the “Website Content”) and the services, products and tools ilumivu offers and makes available on or through the Site (the “Services”). It will also explain how we use and protect that personal information.

This Privacy Policy is a part of our Terms and Conditions of Use.

ABOUT THIS PRIVACY POLICY AND USING OUR SITE AND SERVICES

This Privacy Policy applies to the Site, the Website Content and the Services.

The Site contains links to other websites. Once you enter another website (whether through an advertisement, service, or content link), be aware that ilumivu is not responsible for the privacy practices of these other sites. You should review the privacy statements and terms of use of each website that you visit through a link on our Site.

While you may use some of the functionality of the Site without registration, many of the specific Services on our Site require registration. If you use the Site without registering, then the only information that we collect will be “non-personally identifiable information” as described below. “Non-personally identifiable information” is information that is not traceable back to, and cannot be used to identify, any specific individual.

If you choose to register with the Site, including in order to use any of our Services, then, in addition to collecting certain non-personally identifiable information from you, we require you to submit certain “personally identifiable information”. “Personally identifiable information” is information that can be traced back to an individual, including, for example, your name, home address, telephone number and email address. Depending on the Service you have selected, we may also collect “personal health information”. “Personal health information” is personally identifiable information combined with known health characteristics, including, for example, the name of your child combined with the nature of certain disease or medical condition that your child may have.

You are responsible for ensuring the accuracy of all of the personally identifiable information and personal health information that you submit to ilumivu, the Site, any Website Content or as part of any Service. Inaccurate information will affect the information that you receive when using the Site or Services. For example, if you do not keep your email address current with us, then we may not be able to contact you as described in this Privacy Policy.

NON-PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY ilumivu

We collect non-personally identifiable information about your use of the Site, whether or not you are registered.

Third Party Services and Use of Cookies
We may, from time to time, use the services of third parties (e.g., Google Analytics) to collect non-personally identifiable information about your use of the Site or Services in order for us to, for example, measure activity on the Site. In connection with our use of these third party services, we (or these third party service providers) may use one or more “cookies” to collect this non-personally identifiable information, including traffic data about the Site. “Cookies” are small data files that are stored on the hard drive of the computer that you use to view a website. We do not use cookies to retrieve information from your computer. We do not use these third party services or cookies to collect or track any personally identifiable information or any personal health information, or to combine any non-personally identifiable information obtained from these services with any personally identifiable information or any personal health information that we have obtained from any other source. As part of providing these services to us, our third party service providers may have access to this non-personally identifiable information.

Most web browsers (e.g., Internet Explorer) are initially set to accept cookies. Typically, you can set your browser to refuse cookies or alert you when cookies are being sent (with most browsers, this can be done through a tab on the browser toolbar). However, this may cause some parts of the Site or our Services to not function properly.

IP Addresses
We collect IP addresses through the Site, including upon registration. An IP address is a number that is automatically assigned to your computer when you surf the web. Web servers, the computers that “serve up” web pages, automatically identify your computer by its IP address. When you request a page from the Site, our servers log your IP address, but you will remain anonymous to us because the Site does not link your IP address to any personally identifiable information.

PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY ilumivu

When you register as a member of the Site and/or or when you update your member profile, we collect personally identifiable information that you provide to us, including your name, email address, date of birth, and zip code, and we record the date and time of your registration and agreement to the Terms and Conditions of Use [ilumivu to add hyperlink here] (including this Privacy Policy). We use the personally identifiable information that you provide to respond to your questions, provide you with the specific Services you select, send you emails about Site maintenance and updates, and inform you of significant changes to this Privacy Policy.

Newsletters&Emails
By registering with our Site, you will automatically be signed up to receive, from time to time, recurring informational/promotional newsletters that may be sent by ilumivu or third parties by email. These emails will not contain any personal health information.

In addition, ilumivu or our contractors acting on our behalf, may from time to time, conduct online research surveys in order to gather feedback or opinions about the Site, our Services or certain industry-related or other information, via email invitations, pop-up surveys or online focus groups. You may be asked to voluntarily submit to us personally identifiable information or personal health information as part of these surveys. We use this personally identifiable information or personal health information for our own research purposes and not for sales solicitations. We do not sell or distribute any of this personally identifiable information or personal health information to any third party without your consent or as otherwise permitted by this Privacy Policy. We may, however, use or disclose to others, “aggregated information” from such surveys that does not contain any information that can be attributed to you (see “Aggregated Information” below). We will not knowingly accept survey responses from or conduct interviews with any person who we actually know to be a child under the age of 18.

Registered members can unsubscribe from receiving these emails, newsletters and surveys by making the appropriate election in their online Site profile. Former members or others can unsubscribe from these emails, newsletters and surveys by simply clicking on the “unsubscribe” link at the bottom of any email, newsletter or survey.

Emails You Send to ilumivu
This Privacy Policy does not apply to any content, business information, ideas, concepts or inventions that you send to ilumivu by email. If you want to keep content or business information, ideas, concepts or inventions private or proprietary, do not send them in an email to ilumivu. While we endeavor to respond to emails in a timely manner, we may not always able to do so.

Message Boards and other Public Areas
As a service to our users, we may, from time to time, feature certain blogs, message or bulletin boards, chat rooms, user reviews and other public forums, which may be freely available to visitors to the Site or only to registered members of the Site, and which may be used, for example, by visitors or members with similar interests or conditions in order to share information and support one another, or who wish to post questions for professionals to answer (collectively, the “Public Areas”). “Public Areas” do not include any User Home or Team Pages (as defined below).

Any information (including personally identifiable information and personal health information) that you reveal in a chat room, message board, posting or online discussion in a Public Area, or otherwise post using a service offered in a Public Area, is open to the public and is not a private, secure service. You should think carefully before disclosing any personally identifiable information and personal health information in any Public Areas. What you have written may be seen, disclosed to or collected by third parties and may be used by others in ways that we are unable to control or predict, including to contact you for unauthorized purposes. As with any public forum on any site, this information may also appear in third-party search engines like Google, Yahoo!, MSN, etc.

You have the option of using a “screen name” in lieu of your real name (or of your child’s name) in all Public Areas of the Site. To use a screen name as described above, go to the “My Profile” page of your User Home or Team Page and add a screen name. Once you do this, your screen name will automatically be used in lieu of your real name in all Public Areas of the Site.

To the extent that other members or users of the Site have the ability to send emails to other members or users as part of any Public Areas of the Site, your actual email address will automatically be replaced with an email link. This email link will allow members or users in these Public Areas to send emails to you but will not let them see or copy your actual email address.

We may use third parties to manage the ilumivu blog(s) on the Site. This may require you to sign up for certain blogging or related services directly with, and provide certain required information to, such third parties. These third parties may share the information you have posted as necessary for us and the third party to provide continued service and to allow you to post your blogs on both the third party blog site and our Site. You should review these third parties’ terms of use and privacy policies carefully, as they will govern, among other things, how those third parties can use your information. We will use your information as described in this Privacy Policy.

User Home or Team Pages
If you choose to create a personal home or team page or other pages and tabs under the “My Program” tab (including under the “My Home”, “My Profile”, “My Children”, “My Team” and “My Schedule” sub-tabs) on the Site (collectively, the “User Home or Team Page”), you will be required to show your real full name and email address on your User Home or Team Page. In addition, you will be permitted, but not required, to enter other personally identifiable information, personal health information, and other information about yourself or your children, on your User Home or Team Page.

All ilumivu employees and staff members, including ilumivu Professionals, Coordinators, Facilitators and Coaches (the “ilumivu Team Members”) will automatically have, at all times, full access to the personally identifiable information, personal health information and other information contained on your User Home or Team Page, and will automatically be, at all times, members of your User Home or Team Page “team”. You are not permitted to block or prevent access to your User Home or Team Page or any of the information (including personally identifiable information or personal health information) contained on your User Home or Team Page by any ilumivu Team Members.

Except for ilumivu Team Members, you have the exclusive ability to control and authorize all other persons who can gain access to your User Home or Team Page and become members of your team (“Non-ilumivu Team Members”). All of your Non-ilumivu Team Members must be registered members of the Site. All of your Non-ilumivu Team Members shall, at all times that they are members of your User Home or Team Page team, have full access to the personally identifiable information, personal health information and other information contained on your User Home or Team Page. Accordingly, you should consider carefully each person who you choose to become your Non-ilumivu Team Member and grant access to the personally identifiable information, personal health information and other information contained on your User Home or Team Page. You may add or delete Non-ilumivu Team members at any time by going to the My Team/Team Assignment page on your User Home or Team Page.

Each of your ilumivu Team Members and Non-ilumivu Team Members is permitted to enter and post information, including articles, pictures, videos or messages to you or your other team members, communicate via electronic mail or messaging to you or your other team members, and use the other tools available to your team members, on your User Home or Team Page. Except as otherwise described in this Privacy Policy, no persons are permitted to have access to your User Home or Team Page, other than you, the ilumivu Team Members and your Non-ilumivu Team Members.

You are not permitted to block or prevent access to your real full name or email address as shown on your User Home or Team Page. All RTA Team Members and your Non-RTA Team Members will have access to this information at all times that you keep your User Home or Team Page in existence.

By accepting any invitation and becoming a Non-ilumivu Team Member of the User Home or Team Page of any other registered member of the Site, certain of your personally identifiable information (including your real full name and email address) will be available to all other team members and the creator of such User Home or Team Page. In addition, any other personally identifiable information, personal health information or other information that you voluntarily choose to disclose on another member’s User Home or Team Home page will be available to all team members and the creator of such User Home or Team Page. You are not permitted to block or prevent access to your real full name or email address as shown on any User Home or Team Pages of which you are a member. All ilumivu Team Members and Non-ilumivu Team Members and the creator of each such User Home or Team Page will have access to your real full name and email address at all times, until you terminate your membership to the Site or your status as a team member of such User Home or Team Page. In addition, all ilumivu Team Members and Non-ilumivu Team Members and the creator of each such User Home or Team Page will have access to all other personally identifiable information, personal health information or other information that you voluntarily choose to disclose on such User Home or Team Page, at all times, even after you terminate your membership to the Site or your status as a team member of such User Home or Team Page, for as long as the creator of that User Home or Team Page chooses to keep that information on his or her User Home or Team Page in existence.

Access, use or misuse of any of the personally identifiable information, personal health information and other information contained on your User Home or Team Page by any of your Non-ilumivu Team Members, or contained on any other member’s User Home or Team Page of which you are a member by any Non-ilumivu Team Member or the creator of such User Home or Team Page, is at your sole risk, and ilumivu has no liability or obligation to you in connection with such access, use or misuse.

Accordingly, you should think carefully before disclosing any personally identifiable information or personal health information on any User Home or Team Page.

My Messages Center
ilumivu and each member of your User Home or Team Page “team” have the ability to use personally identifiable information and personal health information that you provide to send you personalized emails or electronic messages through the “My Messages” center on your User Home or Team Page. All of your team members will have access to and be able to view these emails and messages on your User Home or Team Page.

ilumivu Services and Subscription Services
After registering as a member of the Site, you may choose to use certain Services, including Services that require payment to ilumivu (the “Subscription Services”), that may ask you to provide other types of information about yourself or your children, including personal health information. ilumivu or the Site will retain and may use your personal health information as part of providing these Services and otherwise as stated in this Privacy Policy.

ilumivu uses PayPal to process payments for Subscription Services and will not accept any credit card, bank account or other financial information directly from you. When making a payment, you will be redirected to a PayPal-hosted page and be subject to PayPal’s agreements, terms and conditions and privacy policy, all of which can be found on the PayPal website. PayPal notifies us that your payment has been processed, including the date and amount of your payment, but we do not see your credit card, bank account or other financial information. Please do not send any of this information to us; we will not accept it and, if received, will promptly destroy or delete such information.

Email a Friend
If you choose to use our “Email a Friend” service to tell a friend about our Site or newsletter, then we will ask you for your name and email address and your friend's email address. We will automatically send your friend a one-time email inviting him or her to visit the Site using your name and email address as the from email address, and we will add your friend’s email address to our mailing list for our Newsletters&Emails as described above. We do not use your name, your email address or your friend's email information or the information you provide using this service for any other purposes. We will only use the information you provide to send the email you request and our other newsletters and emails.

Data Warehouse Analysis
We may, from time to time, send your personal health information in a form that cannot be used to personally identify or contact you to a data warehouse for statistical analysis. We require these data warehouses to agree that they will not attempt to make this information personally identifiable, such as by combining it with other databases.

Children
We are committed to protecting the privacy of children. Neither ilumivu nor any of its Services are designed or intended to attract children under the age of 13. We do not collect personally identifiable Information from any person who we actually know to be a child under the age of 13.

We also do not permit any person who we actually know to be a child under the age of 18 to become a member of the Site, to receive or subscribe for any Subscription Services, or to create or enter or post information to any User Home or Team Page.

A parent or legal guardian of a child under the age of 18, however, may use the Site or the Services, including any Home Page or Team Page, for the benefit of or in connection with his or her child. The parent or legal guardian of such child: (1) is solely responsible for determining and reviewing what personally identifiable information, personal health information or other information concerning such child is disclosed, made available, entered or posted to the Site or any User Home or Team Page or as part of any Service, (2) is solely responsible for supervising such child’s actions and decisions, and for protecting such child, in connection with the Site or any Service (or any use by such child of the Site or any Service), and (3) agrees that such personally identifiable information, personal health information or other information concerning such child shall be treated under this Privacy Policy and our Terms and Conditions of Use in the same fashion as if it were such parent’s or legal guardian’s own personally identifiable information, personal health information or other information. The parent or legal guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through the Site or Services for his or her child under the age of 18.

Aggregated Information
We may combine, in a non-personally identifiable format, the personal health information that you provide with the personal health information that are provided by other users in one big “batch” to create aggregate information that may be disclosed to third parties. Aggregate information does not contain any personally identifiable information that could be used to contact or identify you or your children. For example, ilumivu may use information gathered to determine the total number of users of the Site from Boston, Massachusetts. ilumivu will not disclose your personal health information to any third party without your prior permission, except as otherwise permitted by this Privacy Policy. Aggregated information, such as information on traffic patterns within the Site, is also collected through various methods.

INFORMATION COLLECTED BY CERTAIN THIRD PARTIES

Websites linked to on our Site, including those of our sponsors or advertisers, may use their own cookies or other online tracking technologies in the banner advertisements served on the Site and in emails, special promotions or newsletters that we send to you. Some advertisers use companies other than ilumivu to serve their ads and to monitor users’ responses to ads, and these companies (“Ad Servers”) may also collect information through the use of cookies or other online tracking technologies on our Site. In certain situations, information collection may be facilitated by momentarily directing your browser to the website of an Ad Server or other third party acting on behalf of the sponsor or advertiser before re-directing your browser to its selected destination (e.g., back to the Site to show the ad, or to the advertiser’s website). This re-direction process will not be apparent to you.

We do not control these third parties’ use of cookies or other online tracking technologies, or how they manage the information that they gather through such use. These third parties may not follow the same privacy policies as ilumivu. These sites may send their own cookies to you, and may collect data and make uses of it that ilumivu would not. You should review the privacy policy of other websites that you visit or link to from the Site to understand how these other websites use cookies or other online tracking technologies and how they use the information that they collect through such uses on their own websites.

DISCLOSURE OF YOUR INFORMATION

Except as described in this Privacy Policy or as specifically agreed to by you, ilumivu will not disclose any personally identifiable information or personal health information that it gathers from you on the Site or our Services. We may only release personally identifiable information or personal health information to third parties: (1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as in response to a physical threat to you or others, to protect property or defend or assert legal rights. In the event that we are legally compelled to disclose your personally identifiable information or personal health information to a third party, we will attempt to notify you unless doing so would violate the law or court order. In addition, we may disclose personally identifiable information or personal health information as described below.

Access by Team Members
As described above: (1) all members of your User Home or Team Page “team” will have access to the personally identifiable information and personal health information contained on your User Home or Team Page, and (2) if you accept an invitation to become a member of another user’s “team”, then such user and the members of his or her “team” will have access to certain of your personally identifiable information (including your real full name and email address) and any other personally identifiable information or personal health information that you choose to disclose on such user’s User Home or Team Page. All members or creators of the User Home or Team Pages described above that have access to your personally identifiable information or personal health information have agreed to the terms of this Privacy Policy and ilumivu's Terms and Conditions of Use.

Disclosure to ilumivu and Site Operations and Maintenance Contractors
ilumivu operations and maintenance contractors may sometimes have limited access to your personally identifiable information or personal health information in the course of providing products or services to ilumivu. These contractors include vendors and suppliers that provide us with technology, hosting or other services, and/or content for the operation and maintenance of the Site. Unless you have opted-out of receiving emails and newsletters from ilumivu, these contractors may also have access to your email address to send newsletters or special promotions to you on our behalf or to send emails to you for purposes such as conducting market research on our behalf. Access to your personally identifiable information or personal health information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for ilumivu. We also contractually require that our operations and maintenance contractors: (1) protect the privacy of your personally identifiable information and personal health information consistent with this Privacy Policy, and (2) not use or disclose your personally identifiable information or personal health information for any purpose other than providing us with products and services or as required by law.

Disclosure to Third Party Contractor Websites
Certain content and services offered to you through our Site are served on websites hosted and operated by a company other than ilumivu, including, for example, PayPal (“Third Party Contractor Websites”). ilumivu does not disclose your personally identifiable information or personal health information to these Third Party Contractor Websites without your consent, but you should be aware that any information that you disclose once you access these other Third Party Contractor Websites is not subject to this Privacy Policy. ilumivu does not endorse and is not responsible for the privacy practices of these Third Party Contractor Websites. You should review the privacy policy posted on the each Third Party Contractor Website to understand how that Third Party Contractor Website collects and uses your personally identifiable information or personal health information. ilumivu typically tries to make it obvious to you when you leave our Site and enter a Third Party Contractor Website, either by requiring you to click on a link or by notifying you on the Site before you visit the Third Party Contractor Website.

Disclosure to Linked Sites
In addition to Third Party Contractor Websites that you may access as described above, there may be links on our Site to third party websites sites operated by companies that are not affiliated with ilumivu or the Site or any Service and that do not have contracts to provide content or services through the Site. These links may be found in postings submitted by user of this Site, advertisements, referenced within content, or placed beside the names or logos of sponsors. ilumivu does not disclose your personally identifiable information or personal health information to these third party websites, without obtaining your consent. ilumivu does not endorse and is not responsible for the privacy practices of these sites. If you choose to link to one of these third party websites, you should review the privacy policy posted on this other website to understand how that third party website collects and uses your personally identifiable information or personal health information.

Disclosure of Aggregate Information
ilumivu may provide aggregate information (as described above) to third parties. For example, we may inform third parties regarding the number of users of the Site and the types of activities they conduct while on the Site. Depending on the circumstances, we may or may not charge third parties for this aggregate information. We require parties with whom we share aggregate information to agree that they will not attempt to make this information personally identifiable, such as by combining it with other databases.

HOW WE PROTECT YOUR INFORMATION

ilumivu uses a number of methods to protect and secure your information and privacy. A few examples are as follows:

• We require that members use both a user ID (log-in name) and a password in order to access our Site or any Services (and any personally identifiable information or personal health information included therein).
• We provided users with the option of using a public “screen name” different from his or her real name, in all Public Areas of the Site, such as message boards.
• We do not permit other users or members to view your email address in any Public Areas of the Site.
• We use firewalls to protect information held in our servers.
• We require all ilumivu employees and personnel to abide by our Privacy Policy.
• We back-up our systems to protect your personally identifiable information and personal health information.
• We maintain audit trails that allow you to know who has accessed your User Home or Team Page in the last 90 days. This can be viewed by clicking on “login history” in the “My Account” tab of your User Home or Team Page.
• We provide email and messaging capability on your User Home or Team Page that maintains the contents of all such emails and messages on our Site and servers.
• We limit access to personally identifiable information and personal health information to members of your User Home or Team Page (and you have full control over which Non-ilumivu Team Members have access to this information) and to other members and creators of other User Home or Team Pages of which you voluntarily choose to become a member.
Despite our efforts to protect your personally identifiable information and personal health information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

UPDATING, CHANGING OR DELETING YOUR INFORMATION

The tabs and tools on your User Home or Team Page allow you, at any time, to update, change or delete the information contained on your User Home or Team Page.

Upon termination of your membership with the Site or your User Home or Team Page Service, your User Home or Team Page will be deleted from, and all information displayed on your User Home or Team Page will no longer displayed on, our Site.

Upon termination of your membership with the Site or your User Home or Team Page Service, your name and email address will no longer be displayed in the list of team members of each other User Home or Team Page of which you were a team member at any time prior to such termination. However, any personally identifiable information or personal health information that you voluntarily posted or displayed on each other User Home or Team Page of which you were a team member at any time prior to such termination, will continue to be displayed on such User Home or Team Page, until such time as the creator of such User Home or Team Page voluntarily chooses to delete it or such User Home or Team Page is terminated.

Upon termination of your status as a team member of any other member’s User Home or Team Page, your name and email address will no longer be displayed in the list of team members of such User Home or Team Page. However, any personally identifiable information or personal health information that you voluntarily posted or displayed on such User Home or Team Page, will continue to be displayed on such User Home or Team Page, until such time as the creator of such User Home or Team Page voluntarily chooses to delete it or such User Home or Team Page is terminated.

Except for your name and email address as described above, ilumivu has no responsibility to remove or delete any of your information that is contained on any other member’s User Home or Team Pages. You may contact the creator of any such User Home or Team Page and request that certain of your information be deleted. However, any removal of such information is at the sole discretion of the creator of such User Home or Team Page.

Upon termination of your membership with the Site or your User Home or Team Page, all information that you posted or entered in any Public Areas of the Site will continue to be shown and displayed on such Public Areas. You may request that ilumivu cease displaying certain of such information appearing in the Public Areas of the Site. However, ilumivu has no responsibility to remove or delete any of such information and any removal or deletion by ilumivu of such information is at the sole discretion of ilumivu. To request that ilumivu delete or un-publish any of such information, send an email to ilumivu at support@ilumivu.freshdesk.com and include the URL of the Site page where such information is published, the title of the applicable article, photo or information, and the reason for your request to delete the information. We will notify you by email (to the email address that you provide to us in your request) after your request has been processed.

Upon termination of your membership with the Site or your User Home or Team Page, all information (including personally identifiable information or personal health information) that you submitted to ilumivu at any time, including as part of your member evaluation or as part of any Service, or that you posted or entered on any User Home or Team Page (whether as the creator or a team member thereof), will continue to be stored in ilumivu databases and may continue to be used by ilumivu in a de-identified form, in accordance with this Privacy Policy for as long as ilumivu sees fit.

You should also review carefully the provisions of the Terms and Conditions of Use relating to “TERMINATION” for important information about what happens to your personally identifiable information and personal health information upon termination or cancellation of your membership to the Site or use of any Services, including your User Home or Team Page.

Accordingly, you should think carefully before becoming a member of the Site, using any Service or disclosing any personally identifiable information or personal health information on any User Home or Team Page.

CHANGES TO THIS PRIVACY POLICY

ilumivu reserves the right to change the terms of this Privacy Policy at any time upon notice to you as provided in our Terms and Conditions of Use.
